How to use these terms
These Terms of Trade set out what NZ Drive Limited and its clients can expect from each other, for individual driving lessons, the Parent Programme, and corporate or fleet training programmes. They also explain how NZ Drive collects, holds, and uses personal information, in line with the Privacy Act 2020. They work alongside the NZ Drive Team Handbook and Health and Safety Management System, which describe how we operate internally.

General terms
Rules that apply to every client of NZ Drive Limited, whether you're booking a single lesson or a corporate programme.
1. About these terms
These Terms of Trade apply to every booking, lesson, package, and programme provided by NZ Drive Limited ("NZ Drive", "we", "us"). By making a booking, making a payment, or accepting a quote, the client ("you") agrees to be bound by these terms. Where a specific term in Part Three (Individual Learners & Families) or Part Four (Corporate & Fleet Clients) conflicts with a general term in this Part One, the more specific term applies to that type of client.
2. Our services
NZ Drive provides:
- The structured five-stage Learn to Drive programme, for individual learners
- Simulator-based training, including corporate scenario training and youth development sessions
- The Parent Programme, a one-hour on-road coaching session for parents supervising learners
- International driver orientation and senior driver refresher sessions
- Corporate and fleet driver risk assessment, safety training, and the NZ Drive Certified programme
3. Bookings and confirmation
- Bookings are made through our booking system, by phone, or by email, and are confirmed once accepted by NZ Drive
- You must provide accurate information at the time of booking, including learner age, experience level, and any relevant medical or access needs
- NZ Drive may decline or reschedule a booking where a suitable instructor, vehicle, or simulator is not available
4. Fitness to participate
Everyone receiving instruction from NZ Drive must:
- Disclose any medical condition, medication, or impairment that may affect their ability to drive or participate safely
- Not attend a lesson under the influence of alcohol or drugs, or affected by medication that impairs driving ability
- Wear clean clothing and observe reasonable standards of personal hygiene, given that lessons take place in an enclosed vehicle shared closely with an instructor, and often with other clients later the same day
- Accept that the instructor may defer, shorten, or end a lesson where they reasonably believe it is unsafe, or not reasonably practicable in the shared vehicle environment, to continue
If a medical condition, disability, or personal circumstance affects a client's ability to meet any part of this clause, please let us know before the lesson so we can look at reasonable options, such as a shorter session, extra ventilation, or another arrangement.
5. Conduct and instructor authority
NZ Drive instructors are authorised to end a lesson immediately, without refund of that session, where a learner or accompanying person behaves in a way that is abusive, unsafe, or puts any person at risk. Repeated or serious misconduct may result in NZ Drive declining future bookings.
6. Vehicle care and cleaning costs
NZ Drive vehicles are shared across multiple clients on any given day. Where a vehicle requires cleaning beyond normal use, for example due to soiling, strong odour, or spillage arising from a client's presence in the vehicle, NZ Drive may:
- charge the client a reasonable cleaning fee to cover professional valeting or seat cleaning; and
- reschedule or shorten later bookings that day where the vehicle cannot be reasonably used until it has been cleaned, without liability to NZ Drive for that disruption
NZ Drive will let the client know as soon as practicable if a cleaning fee applies, and will provide a receipt or estimate on request. This clause does not apply to reasonable wear and tear from normal instructional use.
7. Photos, data, and privacy
NZ Drive collects and handles personal information in line with the Privacy Policy set out in Part Two of these terms. We do not use learner images, names, or testimonials publicly without separate written consent.
8. Changes to these terms
NZ Drive may update these Terms of Trade from time to time. The current version is the one available on our website or provided at the time of booking. Changes do not apply retrospectively to a lesson or programme already paid for and confirmed.
Privacy policy

9. Purpose and scope
This Privacy Policy explains how NZ Drive Limited collects, holds, uses, and discloses personal information under the Privacy Act 2020. It applies to learners, parents and guardians, corporate client contacts and their nominated drivers, youth programme participants, and visitors to our website.
10. What personal information we collect
- Name, contact details, date of birth, and address
- Driver licence details and driving experience
- Health, medical, or access information relevant to safe participation
- Lesson bookings, attendance, and progress or competency records
- Payment and billing information
- For corporate and fleet clients: nominated driver names and roles provided by the client
- For the youth development programme: referral information provided by Oranga Tamariki or the relevant facility
11. How we collect it
We collect personal information directly from you when you book a lesson, complete a form, or communicate with us. We sometimes collect information indirectly, for example from a parent or guardian booking on behalf of a learner, from a corporate client providing a list of nominated drivers, or from Oranga Tamariki as part of a referral to the youth development programme.
Where we collect personal information about you from someone other than you, we take reasonable steps to make sure you are told that this has happened, why the information was collected, who is likely to receive it, which agency collected and holds it, and your rights to access and correct it, in line with information privacy principle 3A.
12. Why we collect it
- To deliver and schedule lessons, programmes, and simulator sessions safely
- To assess fitness to participate and track learner progress
- To invoice and process payment
- To meet our obligations under the Health and Safety at Work Act 2015 and NZTA driving instructor licensing requirements
- To report to corporate clients on the training and assessment of their own nominated drivers
- To deliver the youth development programme in partnership with Oranga Tamariki
13. How we store and protect it
Personal information is stored in our booking system and business records, and is accessed only by NZ Drive directors and instructors who need it to do their job. We take reasonable security safeguards to protect information against loss, unauthorised access, use, or disclosure.
14. Who we share it with
- NZ Drive instructors delivering your lessons
- Corporate clients, limited to information about their own nominated drivers
- Oranga Tamariki and the relevant facility, for youth programme participants
- NZTA, WorkSafe NZ, or other regulators, where we are legally required to report
- Our payment processor, to complete transactions
We do not sell personal information. Where a service we use, such as booking or payment software, stores data on servers located outside New Zealand, we take reasonable steps to ensure comparable privacy protections apply before that information is disclosed overseas.
15. Access and correction
You may ask to see the personal information we hold about you, and ask us to correct it if it is wrong. Contact us using the details in clause 39 and we will respond within a reasonable time, usually within 20 working days, as required by the Privacy Act 2020.
16. Retention and disposal
We keep personal information only as long as reasonably necessary for the purpose it was collected, or as required by law, including tax and health and safety record-keeping obligations, and dispose of it securely once it is no longer needed.
17. If something goes wrong
If we become aware of a privacy breach that has caused, or is likely to cause, serious harm, we will notify affected individuals and the Office of the Privacy Commissioner, as required under the Privacy Act 2020.
18. Children and young people
Where a learner is under 18, we work with a parent or guardian for booking, consent, and communication. Information relating to participants in the youth development programme is treated with additional care and is shared only as agreed with Oranga Tamariki and the relevant facility.
19. Our website
Our website may use standard analytics or booking tools that collect limited technical information, such as pages visited. We do not use this information to identify you personally.
20. Privacy complaints
If you have a concern about how we've handled your personal information, contact us first using the details in clause 39. If you're not satisfied with our response, you can complain to the Office of the Privacy Commissioner at privacy.org.nz or 0800 803 909.
Individual learners & families
Pricing, cancellations, and what to expect if you're booking lessons for yourself or a family member.
21. Pricing and payment
Lesson and package prices are as published on our website or quoted at the time of booking. Casual lessons and packages are paid at the point of sale (card or eftpos) at or before the lesson. Package holders are not subject to peak-time pricing at any time during their pack.
22. Cancellations and rescheduling
- We ask for at least 24 hours' notice to cancel or reschedule a lesson
- Cancellations with less than 24 hours' notice may be charged at the full lesson rate, except where illness prevents attendance and NZ Drive is notified first thing that morning
- NZ Drive will always try to offer a replacement time where a lesson needs to be rescheduled on our side (instructor illness, vehicle fault or unavailability, or unsafe weather)
23. Learners under 18
- A parent or guardian must complete the booking and agree to these terms on behalf of a learner under 18
- The parent or guardian is responsible for arranging the supervised home practice hours recommended between lessons
- The Parent Programme session can be booked to help a parent or guardian support that practice
24. Refunds and unused packages
Unused lessons within a package remain valid for 12 months from purchase and may be transferred to an immediate family member. Where a refund is requested, lessons already taken are deducted at the equivalent casual lesson rate and the remainder refunded.
25. Your consumer rights
Nothing in these Terms of Trade limits or excludes your rights under the Consumer Guarantees Act 1993 or the Fair Trading Act 1986. Where you are acquiring services as a consumer, those Acts continue to apply in full alongside these terms.
Corporate & fleet clients
Scope of engagement, invoicing, confidentiality, and how business and council contracts work.
26. Scope of engagement
Corporate and fleet services, including fleet risk assessment, driver safety training, emergency procedures training, HR driver evaluation programmes, and NZ Drive Certified, are provided under a written quote or proposal that sets out the specific scope, timing, and price for that engagement. These Terms of Trade apply in addition to, not instead of, that written scope.
27. Invoicing and payment
- Corporate and fleet work is invoiced monthly unless otherwise agreed in writing
- Payment is due within 7 days of the invoice date
- Overdue accounts may incur interest at the lesser of 1.5% per month or the maximum rate permitted by law
28. Cancellations and rescheduling (corporate)
We ask for at least 5 business days' notice to cancel or reschedule a corporate training session, simulator session, or fleet assessment. Sessions cancelled with less notice may be charged in full where an instructor and vehicle or simulator were already allocated.
29. Confidentiality
Both parties agree to keep confidential any non-public information shared in the course of the engagement, including driver assessment results, fleet risk reports, and commercial terms, except where disclosure is required by law.
30. Reports, certification, and intellectual property
Training materials, scenario content, and report templates remain the intellectual property of NZ Drive Limited. Assessment reports and NZ Drive Certified documentation are provided to the client for internal compliance, HR, and reporting purposes.
31. Business client acknowledgement
Where the client is acquiring services for the purposes of a business, the parties agree that the Consumer Guarantees Act 1993 does not apply, to the extent this is permitted by section 43 of that Act. This does not affect the client's rights under the Fair Trading Act 1986, which cannot be contracted out of.
32. Termination
Either party may terminate a corporate engagement on 20 business days' written notice, or immediately in the case of a material breach that is not remedied within 10 business days of being notified.

Liability, insurance, governing law, and how to reach us.
33. Liability and acknowledgement of risk
Driving instruction and driver training involve inherent risk. NZ Drive maintains dual-control vehicles, current insurance, and the safety procedures set out in its Health and Safety Management System, and takes all reasonable care in the delivery of its services.
- Most personal injury in New Zealand is covered under the Accident Compensation scheme, which generally applies instead of a civil claim for personal injury, regardless of anything in these terms
- To the extent permitted by law, NZ Drive's liability for direct loss or damage is limited to the value of the lesson, package, or engagement giving rise to the claim
- NZ Drive is not liable for indirect or consequential loss, including loss of income or delayed test bookings
34. Insurance
NZ Drive vehicles are covered by motor vehicle insurance that includes use for driving instruction. Clients are not required to hold separate insurance to participate in a lesson, unless using their own vehicle for manual-transmission tuition, in which case the client's own vehicle insurance applies.
35. Force majeure
NZ Drive is not liable for a delay or failure to deliver a lesson or programme caused by circumstances reasonably beyond its control, including severe weather, civil emergency, or instructor illness. We will reschedule affected sessions as soon as reasonably possible.
36. Complaints
If something hasn't met your expectations, contact us using the details below. Complaints are acknowledged promptly, the facts are documented, and a director responds directly. This process is described further in the NZ Drive Team Handbook.
37. Governing law
These Terms of Trade are governed by the law of New Zealand. Any dispute is subject to the jurisdiction of the New Zealand courts at Christchurch.
38. Severability
If any part of these terms is found to be unenforceable, the rest of these terms continue to apply.
39. Contact
For corporate and fleet clients: you may be asked to countersign these Terms of Trade alongside a written scope of engagement. This is optional for casual individual bookings, where acceptance occurs at the time of booking or payment.
